SoundExchange is the first organization formed in the United States to collect performance royalties for sound recording copyright owners (SRCOs), featured and nonfeatured artists. SoundExchange is an independent nonprofit performance rights organization that currently represents over 1,000 record companies, their 3000+ labels and thousands of artists united in receiving a fair price for the licensing of their music in a new digital world. On 13/07/2007 SoundExchange has declared its new policy, confirming a minimum fee offer. The big problem is that it seems they have not understood fair use and Creative Commons licenses, on which their service is based on: in exchange for lower royalty fees, they demand digital restriction management (drm) on all webcasts. This would essentially illegalize, on their website, the streaming of any Creative Commons licensed music.

SoundExchange è un organizzazione indipendente senza fini di lucro che si occupa dei diritti sulle esecuzioni (performance) che, attualmente, rappresenta più di 1000 società di registrazione, le loro più di 3000 etichette e migliaia di artisti che ricevono un equo compenso per la concessione in licenza della loro musica in un nuovo mondo digitale. Il 13/07/2007 SoundExchange ha dichiarato la sua nuova politica commerciale, confermando la richiesta di un’offerta minima. Il grosso problema sembrerebbe essere che non hanno compreso sia il significato che le regole del fair use (giusto utilizzo) e delle licenze Creative Commons licenses, su cui è basato il loro servizio: in cambio di basse royalty, chiedono l’adozione di digital restriction management (drm) su tutti i webcast. Questo, essenzialmente, renderebbe illegale lo streaming di qualsiasi musica pubblicata sotto licenza Creative Commons sul loro sito.
